Access to Neighbouring Property
There may be situations where you need to access your neighbor's property to complete repairs on your own property.
For example, you may need to enter their property to fix a shared fence or allow a roofer to use their land to safely place a ladder for roof access. In such cases, you can request access under the By-Law 2023-086 - Right of Access for Maintenance.
This By-Law outlines the rules for accessing your neighbor's property, including the steps you need to follow before, during, and after accessing their land. Below is a summary of the key points, but we encourage you to review the full By-Law to make sure you're following all the necessary procedures:
-
Repairs include maintenance, improvements, or any changes to ensure your property complies with building standards set by relevant laws. Please note that repairs might be subject to inspection by the Town to ensure everything meets regulations.
-
You must notify the Town of Tecumseh at least five (5) days before you plan to access your neighbor's property.
-
If you’re submitting the Notice but aren't the property owner, you’ll need to include an authorization from the owner.
-
Once you submit the Notice, you’ll receive a copy by email, which you should also send to the property owner of the land you're accessing.
While accessing your neighbor's property, please make sure to:
- Only stay for the duration specified in your Notice.
- Ensure there are no hazards left on the property that could be dangerous.
- Restore the property to its original condition and compensate for any damage caused that can’t be fixed.
You are not allowed to:
- Enter any buildings on your neighbor's property.
- Use the property for anything other than the specific repairs mentioned in your Notice.
- Store materials, equipment, or park vehicles on your neighbor's land.
By following these guidelines, you'll help ensure the process goes smoothly and respectfully for everyone involved!
